The role of the LG&SCO has been crucial for the PDS, ensuring compliance by statutory authorities with the law.

The Mental Capacity Act 2005 requires a best decisions process for anyone lacking capacity. This must be individually based and include all relevant services. See Court of Protection page.

The PDS seeks to work collaboratively with all persons and organisations relating to a particular person, especially local statutory authorities who have the responsibility of ensuring that best interests are served in every case. If they fail to comply with this obligation, the Local Government & Social Care Ombudsman can be requested to investigate and compel compliance.
